(The Order of the Court was made by S.Vaidyanathan, J) This Contempt Petition is filed alleging non-compliance of the order passed by this Court on 25.02.2020 in C.M.A.No.91 of 2019. 1 / 3
2. Today (30.10.2023), when the Contempt Petition is taken up for hearing, the learned counsel appearing for the respondent/contemnor submitted that in order to have access to the rear portion of the house, 3 feet width had been made and the building has been re-constructed. Learned counsel further submitted that since 3 feet width has been taken away by the respondent, the extent of land to be given to the petitioner is reduced. Since the petitioner is entitled to 1012.5 Sq.Ft., after modification of the required area, the difference in sq.ft. has to be given to the petitioner on the rear side of the building/house. The respondent is directed to execute the settlement deed as agreed upon by him in the earlier hearing, in respect of 1012.5 Sq.Ft., within a period of six weeks from the date of receipt of a copy of this order.
3. With the above observations/direction and recording the above submissions made by the learned counsel appearing for the respondent, this Contempt Petition is closed.
