The present Writ Petition has been filed for issuance Writ of Certiorarified Mandamus to call for the records of the 1st respondent in connection with the Government Order G.O.(D) No.461, dated 27.07.2016 and quash the same and direct the 1st respondent to refer the dispute declined to be referred under said G.O.(D) No.461, dated 27.07.2016 expeditiously and within such time.
2. When the petition is taken up for hearing on 02.06.2023, the learned counsel for the petitioner submitted that he has given a change of vakalat and therefore, this Court ordered the Registry to verify whether any change of vakalat has been filed on behalf of the petitioner, if not, further, ordered to print the name of the petitioner and list the matter on 09.06.2023. After verifying the records, it is seen that there is no change of 2/4
vakalat filed on behalf of the petitioner. On 09.06.2023, when the matter was taken up for hearing, there was no representation for the petitioner, hence the petition was ordered to be listed on 12.06.2023 under the 'caption for dismissal'.
3. The learned Government Advocate for the 1st respondent as well as the learned counsel for the 2nd respondent submits that the matter has already been settled and hence the learned counsel for the petitioner has not chosen to prosecute the matter, thereby sought to dismiss the petition. In view of the above, the present Writ Petition is dismissed for nonprosecution. Consequently, connected miscellaneous petition is closed. No costs.
