The present criminal original petition has been filed seeking direction to the respondent to permit the petitioner to take the Fruits, Vegetables, Greens, Grains, Pulses and Cereals on regular basis with the petitioner cost and expenses.
2. The petitioner is the convicted accused and class A prisoner at the Central Prison, Puzhal. He is a heart patient and also having ortho problem and piles complaint. Due to his illness, he suffered heavy blood loss. The petitioner was given treatment. The doctor advised the petitioner to take nutritious food to recover from the illness and to compensate the blood loss. When the petitioner is taking medicines to recover, it is just and necessary to take nutritious food. Hence, the petitioner made a representation on 20.06.2015 to provide nutritious food at his expense.
3. Learned counsel for the petitioner submitted that the petitioner is entitled to take nutritious food, subject to medical advice, under Rule 228 of The Tamil Nadu Prison Rules, 1983, but the said representation submitted by the petitioner https://hcservices.ecourts.gov.in/hcservices/
was not considered. Hence, he has come forward to file this petition.
4. This Court on considering the submissions made on either side, directs the respondent to consider the said representation, in the light of the Tamil Nadu Prison Rules, 1983, and pass appropriate orders, preferably, within a period of two weeks, from the date of receipt of a copy of this order. The criminal original petition is disposed of accordingly.
