ORDER
The main writ petition has been filed as against the rejection of the patta proceedings of the petitioner's land. The petitioner was dismissed for non prosecution on 28.06.2022. This petition has been filed for a direction to condone the delay of 1340 days in filing the restoration petition in WP.No.
33326 of 2013.
2. The learned counsel for the petitioner submitted that the pending the writ petition, the writ petitioner has filed a suit in O.S.No.306 of 2023 on the file of the learned First Additional District Court, Tiruvallur for declaration and other reliefs. Hence, submitted that this Court may close this writ miscellaneous petition by granting liberty to the petitioner for filing fresh application before the revenue authority seeking for patta in terms of the decree to be passed by the Trial Court, if the petitioner succeeds.
3. In such view of the matter, this miscellaneous petition stands disposed of granting liberty to the petitioner, if the petitioner succeeds in the suit, shall make a fresh application before the revenue authority claiming patta in terms of the decree to be passed by the trial Court. It is also made clear that the impugned orders dated 12.08.2013 & 13.06.2022 is subject to the result of the pending civil suit.
4. Accordingly, this writ miscellaneous petition stands disposed of. No costs.
