Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the 1st to 3rd respondents to take appropriate action against the 6th and 7th respondents against the illegally constructed floor of the building bearing Door No.97, Astabujam Road, Choolai, Chennai600 112, belongs to the 6th and 7th respondents, without obtaining planning permission from the third respondent. ORDER
(Order of the Court was made by The Hon'ble Chief Justice) We are informed that the premises was de-sealed for the purposes of removal of the goods and that aspect need not engage our attention. The premises was also permitted to be inspected by the consultants of the petitioner and the learned counsel submits that the consultants/structural engineers are in the process of preparing a report. She submits that this report will be filed with the Corporation within a week, whereupon the Corporation may examine the same.
2. The affidavit of the Executive Engineer-VI of the Corporation of Chennai affirmed on 03.03.2016 states that Enquiry Officer has been appointed and he will submits his report within 30 days, whereafter further disciplinary action will be taken based on the enquiry report.
3. We are of the view that no further directions are required from us and the matter will proceed in accordance with law and we can only monitor for some time for compliance.
4. The writ petition, accordingly, stands disposed of. No costs.
