This petition has been filed to condone the delay of 333 days in filing the above captioned C.M.A.

2. The learned counsel appearing for the petitioner submitted that the first respondent remained exparte before the Tribunal; that notice to him may be dispensed with.

3. Heard the learned counsel for the petitioner and the learned counsel for the second respondent. In view of the submission made by the learned counsel for the petitioner, notice to the first respondent is dispensed with.

4. Since I am satisfied with the reasons in the affidavit filed in support of this application, the delay is condoned. Hence, this petition is ordered as prayed for.

5. Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
