PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the 1st respondent with the assistance of respondent Nos. 2 to 6 to remove the steel bunk and all the articles and things belonging to the 7th respondent ordained for the purpose of encroaching the frontage of the petitioner, M/s. Senthil Service Station at No. 11, GST Road Pallavaram, Chennai -44 by way of re-erection of encroachment which was hitherto removed by

the respondent 1 to 6 and thereon restrain the 7th respondent from in any manner re-erecting or putting any structure by illegal and unlawful encroachment in the said land belonging to the highways department.

ORDER

Reference may be made to the order dated 25.11.2015. On the said day, there was no representation on behalf of the petitioner hence the matter was posted for dismissal today.

2. However, today also when the matter is taken up for hearing, there is no representation for the petitioner. In the light of the above it is evident that the petitioner is not willing to get along with the matter hence, the present writ petition is dismissed for non-prosecution. No costs.
