The first defendant has filed written statement along with the application to condone delay. In the affidavit, it is stated that due to prevailing pandemic Government restriction and lockdown since March 2020, the first defendant institute has not been functioning and was not in a position to give instruction to the counsel to file written statement.
2.Taking note of the said reason and the order passed by the Hon'ble Supreme Court in suo motu Writ Petition granting moratorium in respect of reckoning limitation during the pandemic period, the delay is condoned. Application No.2630 of 2021 is allowed. The written statement of the first defendant is taken on file.
3. Learned counsel for the second defendant states that the counter affidavit filed on 22.02.2021 to be treated as written statement of the second respondent. The counter affidavit of the second defendant is taken on file as their written statement for the suit.

Vri 4.The third defendant in this matter already been set exparte and the suit against the fourth defendant was dismissed vide order dated 08.07.2021. Since the pleadings of the contesting parties is completed, the matter is posted for affidavit of admission and denial on 23.08.2021. Call the matter on 23.08.2021.
