ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.08.2025 for the offences punishable under Sections 5(1), 5(j)(ii), 5(n) read with Section 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 351(2) of BNS, 2023 in Crime No.257 of 2025 on the file of respondent police seeks bail.

2.The allegation against the petitioner is that the petitioner is the relative of the victim minor girl who is aged about 13 years, had committed penetrative sexually assaulted and she became pregnant. The respondent police registered a case against the petitioner and he was arrested and remanded to judicial custody on 29.08.2025.

3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that there was some money dispute between the petitioner and the family of the de-facto complainant. He further submitted that a false complaint has been lodged against the petitioner and he was arrested and remanded to judicial custody on 29.08.2025. He further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prayed for grant of bail to the petitioner.

Mr.V.J.Priyadarsana, learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and submitted that final report has not yet been taken on file. He further submitted that the petitioner is being a relative of the victim minor girl and if he released on bail, he would tamper the witnesses. He further submitted that two bail applications have also been dismissed by this Court. Therefore, he opposed to grant bail to the petitioner.

5.Considering the gravity of offence alleged against the petitioner, who is a relative of the victim minor girl and though it is stated that the investigation has been completed, the final report has not yet been filed before the Trial Court; if bail is granted to the petitioner, he would tamper the witnesses, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition shall stands dismissed. 06-05-2026 Index: Yes/No Speaking/Non-speaking order MSM
