THE PUBLIC PROSECUTOR PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 353, 307 and 506(ii), 430, 379 I.P.C. r/w 21(1) M.M. Act in Cr.No.311 of 2019 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner is alleged to have been involved in theft of sand.

3.Heard the arguments advanced on either side and perused the materials available on record.

4.Perusal of records disclose that earlier the petitioner filed Crl.O.P.No.380 of 2020 seeking anticipatory bail and this Court vide order dated 13.01.2020 dismissed the said petition. This is the second anticipatory bail petition filed by the petitioner before this Court.

5.Further, the petitioner did not establish any change in circumstances for grant of anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

6.Considering the facts and circumstances of the case and also the fact that there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. The criminal original petition is accordingly dismissed.
