C.M.P.No.19879 of 2016 in CMA.SR.No.84875 of 2016 R.SUBBIAH.J, and M.S.RAMESH.J, This petition has been filed by the petitioner/appellant to condone the delay of 28 days in preferring the above appeal.

2.Heard the learned counsel for the petitioner/appellant. It appears that notice was served on the respondent and the name of the respondent is also printed in the cause list today. Inspite of the same, the respondent has neither chosen to appear in person or through counsel before this Court today.

3.Being satisfied with the reasons stated in the affidavit filed in support of the petition and moreover, the delay is not inordinate in nature in preferring the above appeal, we are of the view to condone the delay.

Accordingly, the delay is condoned and the petition stands allowed.
