O R D E R

The present petition has been filed to direct the respondents to register the FIR based on the petitioner's complaint dated 14.09.2015.

2. The petitioner herein has stated that he is the absolute owner of 2.70 acres extent of land in Survey No.69 of Pulavarpalli Village, Vellore District, and he is also the absolute owner of the house and land in Survey No.41/2M of Pulavarpalli Village, Vellore District. The lands in Survey No.16 belong to one Kuppusamy and Govindaammal who were none other than the grandfather and mother of the petitioner. The petitioner had given the original documents in order to get encumbrance certificate to one Rajasekaran and the said Rajasekaran with an illegal intention to grab the properties colluded with one Prakasam, who is working as Assistant in Sub Registrar Office, Vaniymbadi, had forged a Will in favour of Narayaniammal wife of Sankaran and registered the forged https://hcservices.ecourts.gov.in/hcservices/

document in favour of Sankaran. Further, all the four persons conspired together and executed a sale deed in favour of one J.Rameshbabu. Hence, a complaint was lodged on 14.9.2015 with the 2nd respondent police. Since no action was taken so far, the present petition has been filed.

3. Learned Additional Public Prosecutor submitted that the complaint was received by the respondent police and the same was transferred to Alangayam Police Station and if the petitioner gives a copy of the complaint before the Alangayam Police Station, the same will be considered.

4. Considering the factual aspects of the case, without going into the merits and demerits of the case, this Court directs the petitioner to give a copy of the complaint dated 14.09.2015 along with the copy of this order before the Alangayam Police Station. On receipt of the said complaint the Inspector of Police, Alangayam Police Station, Alangayam, is directed to conduct an enquiry given by the petitioner and if the materials gathered indicates commission of any cognizable offence, he is directed to proceed further in accordance with law, as early as possible.

5. Accordingly, the criminal original petition is disposed of.
