ORDER
This petition is filed to relax the condition that the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders imposed by the Court vide common order dated 21.03.2025 in Crl.O.P.No.7149 of 2025.
2. Learned counsel for the petitioner submits that the petitioner furnished the sureties before the learned Judge, Principal Special Court under EC & NDPS Act, Chennai on 02.04.2025 and the petitioner also appearing before the respondent police on everyday at 10.30 am., without any default. Since, the petitioner is permanent resident of Delhi and he is the sole breadwinner of his family, the petitioner has preferred this petition, praying to relax the condition to report before the respondent police daily at 10.30 a.m., until further orders.
3. Learned Government Advocate (Crl.Side) appearing for the respondent police submits the investigation in this case is at a crucial stage, and since the other accused is still absconding, granting the relief to the petitioner may lead to absconding and hampering the investigation. Therefore, the learned
Government Advocate vehemently prays for the dismissal of this petition.
4. Having considered the submissions of both sides and noting that the co-accused is still absconding, this Court finds no reason to modify the condition as prayed for.
