Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.No.332 of 2018 on the file of the High Court, the High Court will be pleased to grant interim bail for three days for attending the ceremonies at his home town in Crl.A.No. 332 of 2016 and pass such further or other orders. Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.332 of 2016 on the file of the High Court and upon hearing the arguments of MR.SAI KRISHNAN Advocate for the petitioner and of MR.R.RAVICHANDRAN Government Advocate on behalf of the Respondent the court made the following order:- The petitioner/accused was convicted and sentenced to undergo rigorous imprisonment for a period of 10 years and imposed a fine of Rs.1000/-, by judgment dated 24.02.2016 made in S.C.No.82 of 2011 by the learned VI Additional Sessions Judge, Chennai, for the offence under Section 304 (1) of IPC.
2 The learned counsel for the petitioner/accused would submit that the petitioner's mother died on 08.09.2018 and 16th day ceremony for his mother is scheduled to be held on 23.09.2018 at the petitioner's home town. Hence the petitioner seeks interim bail under section 389 (1) Cr.P.C. for the alleged offence under Sections 304 (i) of IPC.
3 Considering the fact that 16th day ceremony of petitioner's mother is scheduled to be held on 23.09.2018, the petitioner is granted interim bail for a period of three days from 21.09.2018 to
23.09.2018. Accordingly, it is ordered that the petitioner shall be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety to the satisfaction of the learned XXIII Metropolitan Magistrate, Saidapet, Chennai, and the petitioner shall surrender before the Superintendent, Central Prison, Puzhal, Chennai, on 24.09.2018 before 12.00 noon. -sd/- 20/09/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
