ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 02.04.2022 at the hands of the respondent police for the offences punishable under Sections 376(2)(n), 376(3), 506(i) of IPC and Section 5(l)(n), 5(j)(ii) r/w Section 6 of POCSO Act, 2012 in Crime No.5 of 2022, seeks bail.
2. The case of the prosecution is that the petitioner herein had committed penetrative sexual assault earlier on the victim girl aged about 14 years. Hence the complaint.
3. After the demise of the parents of the victim girl, the petitioner who is the paternal uncle of the victim girl have committed penetrative sexual assault on the victim girl on three occassions. Due to which she also got pregnant. https://hcservices.ecourts.gov.in/hcservices/
4. Therefore the petitioner had committed serious offence against the minor girl aged about 14 years. Hence, this Court is not inclined to grant bail to the petitioner.
