PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the respondent herein to register a case based on a complaint date 03.09.2018 given by the petitioner and investigate the matter in accordance with law.

O R D E R

This petition has been filed to direct the respondent to register a case based on the complaint given by the petitioner dated 03.09.2018.

2. The learned counsel for the petitioner has submitted that the petitioner is running a business in the name and style of S.P.Aqua lively along with one Sahana. He further submitted that when the petitioner was in two months rest due to ill-health, the said Sahana along with one Venkatesh and Jayaprakash conspired to sell the business and compelled the petitioner to execute documents and also criminally intimidated and hence, the petitioner has lodged a complaint before the respondent on 03.09.2018, but so far no action has been taken.

3. The learned Additional Public Prosecutor (Crl.Side) has submitted that the petitioner's complaint is still pending for enquiry.

4. Considering the aforesaid submissions, the respondent is directed to expedite the enquiry. If the enquiry reveals any cognizable offence, he has to register a case and proceed https://hcservices.ecourts.gov.in/hcservices/

in accordance with law. In case, the enquiry reveals only a civil dispute, the respondent has to direct the petitioner to approach the civil court and get appropriate relief.

5. With the aforesaid directions, this petition is disposed of.
