Respondent(s) PRAYER This Writ Petition is filed under Article 226 of Constitution of India seeking Writ of Certiorarified Mandamus to call for the entire records in respect of the order passed by the respondent dated 08.12.2008 in G.O.(2D) No.705 which was confirmed by the order dated 15.05.2009 G.O.(2D) No.209 and G.O.(2D) No.570 dated 3.12.2010, G.O.(2D) No.427 dated 08.08.2013 and G.O(2D) No.187 dated 17.03.2016 and quash the same consequently direct the respondent to permit the petitioner to retire from service and pay all pensionary and other benefits.

ORDER

This petition is filed by the petitioner seeking quashment of order passed by the respondent dated 08.12.2008 in G.O.(2D) No.705 which was confirmed by the order dated 15.05.2009 G.O.(2D) No.209 and G.O.(2D) No.570 dated 3.12.2010, G.O.(2D) No.427 dated 08.08.2013 and G.O(2D) No.187 dated 17.03.2016 and for consequential direction to the respondent to permit the petitioner to retire from service and pay all pensionary and other benefits.

2. It was brought to the notice of this Court on 25.07.2025 that the petitioner had passed away and the learned counsel for the petitioner sought time to bring the legal heirs of the deceased petitioner on record.

3. However, the learned counsel appearing on record for the petitioner informed that the files was taken back long ago and till dated, no steps have been taken to prosecute the Writ Petition.

4. As per the records and the information provided by the learned counsel

for the respondent, a departmental enquiry was initiated against the petitioner regarding disproportionate assets, resulting in his dismissal from service. Subsequently, the Vigilance Department pursued the disproportionate assets case in the Criminal Court.

5. In view of the petitioner's demise, the cause in the present Writ Petition does not survive. Any grievances arising from the petitioner's death, including claims to benefits, may be pursued by the legal heirs of the petitioner in manner known to law.

6. With the above observations, this Writ Petition is closed. No costs. K.SURENDER, J.
