Contempt Petition filed Under Section 11 of Contempt of Courts Act, 1971, to punish the respondent for the non compliance of the order passed in W.P.No.4526 of 2018 dated 09.04.2018.

ORDER

This contempt petition has been filed alleging willful disobedience of the order passed by this Court in W.P.No. 4526 of 2018 dated 09.04.2018.

2. The contempt complaint is on the ground that the respondent/Municipality has not inspected the property for making a fresh assessment of property tax.

3. Mr.P.Srinivas, learned Standing Counsel for the respondent/ Municipality submitted that there are more than 400 cases where reassessments are to be done and therefore requests that reasonable time may be granted to the respondent Municipality.

4. I find that on account of not commencing reassessment proceedings, the petitioner cannot be stated to be aggrieved nor it can be stated to be the case of willful disobedience.

5. While closing this contempt petition, a direction is issued to the respondent Municipality Corporation to comply with the direction of this Court in its letter and spirit within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. With the above observations, the contempt petition is closed.
