This application has been filed seeking condonation of delay of 1058 days in filing the written statement. The reason set out for the delay is that the second defendant being a resident of United States was unable to collect the records and instruct his counsel to file the written statement. It is also stated that since the documents were handed over by the first defendant to the purchaser of the suit property namely, 4th defendant it had become difficult for the applicant to recover the documents and file his written statement.

2. Considering the nature of the suit and the reasons set out for the delay in filing the written statement, I am of the considered opinion that the applicant deserves a chance to defend the suit on merits. Hence, this application is allowed, the delay of 1058 days in filing the written statement is condoned on condition the applicant pays a sum of Rs.5,000/- as costs to the Tamilnadu Advocate Cleark's Association on or before 16.09.2019. Post on 17.09.2019 for compliance.
