ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the respondents to pay the enhanced compensation at the rate of Rs.2400/- per Sq.ft., with all other benefits to the petitioner under Section 28A of the Land Acquisition Act, 1894 [hereinafter referred to as "the Act"] pursuant to the judgement and decree passed by the Sub Court, Tambaram on 28.04.2015 in LAOP No.12 of 2012.

2.The case of the petitioner is that her lands were acquired under the Act. The award came to be passed on 13.08.2008 in Award No.1 of 2008. Aggrieved by the quantum of compensation, LAOP.Nos.11 and 12 of 2012, were filed before the Sub Court, Tambaram. The Sub Court, Tambaram through judgement and decree dated 28.04.2015 enhanced the compensation amount to Rs.2400/- per sq.ft. The petitioner has taken a specific stand that this order has become final. Hence, the petitioner submitted a representation before the respondents to pay the enhanced compensation amount in line with Section 28A of the Act. Since the same was not considered, the present writ petition has been filed before this Court. 3.Heard Mr.J.Ram, learned counsel for the petitioner and Mr.P.Sathish , learned Additional Government Pleader for respondents. 4.

The issue involved in the present writ petition is squarely covered by the earlier order passed in WP.No.1279 of 2025. This Court took note of the judgement of the Apex Court in Narendra and Others v. State of Uttar Pradesh and Others reported in (2017) 9 SCC 426 and held that where there is enhancement of compensation for the other land owners under the same acquisition, the said benefit must also enure in favour of the persons whose neighbouring lands were acquired under the same acquisition.

5.By following the above order, there shall be a direction to the 2nd respondent to deal with the representation made by the petitioner and pass final orders within a period of three months from the date of receipt of copy of the order. 6.This writ petition is disposed of with the above directions.
