Comp.A.No.215 of 2022 in C.P.No.180 of 2009 Comp.A.No.215 of 2022 in C.P.No.180 of 2009 M.SUNDAR, J., Captioned application has been filed with a 'condonation of delay' ['COD'] prayer qua claim of applicant i.e., State Bank of India [SBI].

2. In paragraph No.11 of support affidavit, it has been mentioned that neither petitioning creditor nor Official Liquidator had published/advertised winding up order.

3. However, Mr.Bavisetty Sridhar, learned 'Deputy Official Liquidator' [hereinafter 'Deputy OL' for the sake of convenience and clarity] on behalf of 'Official Liquidator attached to this Court' [hereinafter 'OL' for the sake of brevity] submits that publication inviting claims has in fact been made.

4. Faced with the above situation, Mr.R.Imayavaramban, learned counsel of M/s.Ramalingam and Associates (Law Firm) submits that SBI has failed to notice the publication inviting claims, this was due to inadvertence.

5. Considering the fact that SBI is also dealing with public money and considering the stand of learned Deputy OL that he has no serious objection/opposition to COD prayer being acceded to, captioned application is ordered as prayed for albeit with a directive that SBI shall make their claim before OL along with all original supporting documents within a fortnight from today i.e., on or before 08.07.2022. If SBI does not make claim on or before 08.07.2022, this order will stand effaced.

6. Captioned COD application ordered in the aforesaid manner. There shall be no order as to costs.
