It is represented by the learned counsel for the appellants that the 5th respondent is dead and that respondents 1 to 4 and respondents 6 and 7 in the Second Appeal are the legal heirs of the deceased 5th respondent. A memo to that effect has been filed by the learned counsel for the appellants and the same is recorded.

2. The present petition is filed under Order XXII Rule 4 CPC to bring on record the respondents 8 to 10 herein as the legal representatives of the deceased first respondent and rank them as respondents 8 to 10 in the S.A. No.122 of 2007.

3.The learned counsel for the respondents did not raise any serious objection and this Court is satisfied with the reasons assigned in the affidavit filed in support of this petition. Hence, the petition is allowed. 4.The Registry is directed to carryout necessary amendments in the Second Appeal No.122 of 2007 and list the matter for final hearing after four weeks.
