O R D E R

This petition has been filed seeking a direction to the respondents to register a case based on the complaint of the petitioner dated 29.09.2015.

2. It is seen that the accused Rubasthri, wife of Vasudevan was employed in the petitioner's school as a billing clerk handling cash collections cum office assistant for the period of one year and four months from 16.04.2014 to 22.08.2015. It was brought to the notice of the petitioner's knowledge that she has been constantly swindling the https://hcservices.ecourts.gov.in/hcservices/

institution's revenue and she has been tampering with the records to conceal her illegal act. The proof for such misappropriation of funds is enclosed herewith. When the management sought for explanation and demanded reasons in connection with the aforesaid misappropriation, the accused admitted her fraudulent act of swindling and misappropriation of the management funds and also threatened the institution that she will commit suicide. Hence, the petitioner has lodged before the respondents police. But, till the date no action has been taken by the respondents police. Hence, the petitioner has filed the present criminal original petition.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(P) appearing for the respondents and perused the materials available on record.

4. Considering the submissions made on either side, this Court is of the opinion that the respondents are directed to conduct enquiry based on the complaint of the petitioner dated 29.09.2015 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the respondents are directed to proceed further in accordance with law, preferably within a period of two months.

5. With the above directions, this criminal original petitions is disposed of.
