The Inspector of Police R-7, K.K.Nagar Police Station Chennai (Crime No.817 of 2020) PRAYER: Criminal Original Petition is filed under Section 439 of Criminal Procedure Code to enlarge the petitioner on bail in Crime No.817 of 2020 pending investigation on the file of the respondent police.

ORDER

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 04.08.2020 for the offences punishable under Sections 341, 294(b), 336, 397, 506(ii) IPC, in Crime No.817 of 2020, on the file of the respondent police, seeks bail.

2.The case of the prosecution as per the defacto complainant one Jagadeesan is that on 03.08.2020 while he was passing along the K.K.Nagar Ponnambalam Salai, Amman Koil Police Booth, the petitioner along with other accused waylaid him and by threatening with knife robbed a sum of Rs.1,000/- from him.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner was arrested on 04.08.2020 and he is in judicial custody for the past 40 days.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police would vehemently oppose for the grant of bail to the petitioner stating that the petitioner on 03.08.2020, waylaid the defacto complainant, threatened him with knife point and robbed a sum of Rs.1,000/-. He would further submit that the petitioner has 17 previous cases pending against him in various police stations and the investigation is pending. He would further submit that the petitioner was arrested only on 04.08.2020.

5.Taking into consideration of the fact that the petitioner has 17 previous cases pending against him in various police stations, and also considering the fact that the petitioner was arrested only on 04.08.2020 and the investigation is in initial stage, this Court is not inclined to grant bail to the petitioner. 6.This Criminal Original Petition stands dismissed accordingly. -sd/- 16/09/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
