The petitioner has filed this petition to condone the delay of 283 days in filing the appeal against the award passed by the Motor Accidents Claims Tribunal, Special Sub Court, Tiruvannamalai in MCOP No.285 of 2017, dated 06.10.2018.
2. Mr.C.S.K.Satish, learned counsel takes notice for the respondent.
3. Considering the submissions made by the learned counsel and being satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay is condoned and this petition is allowed. In the event of the compensation amount is being enhanced, the appellant is not entitled for interest for the default period.
4. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise the papers are found to be in order and print the name of Mr.C.S.K.Satish, for respondent and post the matter on 30.11.2020 for admission.
