(CR.NO.243/2019) [ RESPONDENT ] Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed on her in the Order in Crl.O.P.No.6037 of 2020 dated 21.07.2020, i.e., the petitioner shall deposit a sum of Rs.5,00,000/- Rupees Five Lakhs Only) to the credit of the Crime No.243 of 2019 on his appearance before the Magistrate and on such deposit being made, the learned Magistrate concerned is directed to disburse the said amount to the victims after taking appropriate undertaking affidavit and acknowledgement from the victims regarding receipt of the amount.(CRL.MP.NO.5470 of 2020) Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.M.F.
SHABANA, Advocate for the petitioner and of PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The petitioner has filed this petition seeking to modify the condition imposed on her in the order in Crl.O.P.No.6037 of 2020 dated 21.07.2020, i.e., the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of the Crime No.243 of 2019 on his appearance before the Magistrate and on such deposit being made, the learned Magistrate concerned is directed to disburse the said amount to the victims after taking appropriate undertaking affidavit and acknowledgement from the victims regarding receipt of the amount.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate.
3. The learned counsel appearing for the petitioner would submit that due to COVID - 19 lockdown, the petitioner was not able to deposit the amount of Rs.5 Lakhs imposed by this Court to the credit of crime number. The learned counsel would further submit that though the petitioner has filed this petition seeking modification of the condition, this Court need not modify the condition, however, may grant time for a further period of four weeks from the date of receipt of a copy of this order to comply with the said condition.
4. The learned Government Advocate raise no serious objection for this Court granting further time.
5. Time for complying with the conditions imposed on the petitioner in the order dated 21.07.2020 passed in Crl.O.P.No.6037 of 2020 is extended by a further period of four weeks from the date of receipt of a copy of this order.
