The present criminal original petition has been filed seeking a direction to the respondent to register the complaint dated 11.09.2015 on the file of the respondent police.
2. In the petition, it has been stated that on 11.09.2015, while the petitioner was proceeding in his two wheeler bearing Reg.No.TN 10 AR 4772 (Honda Activa) at Rangarajapuram Main Road in Kodambakkam, a group of five persons attacked the petitioner and took away his two wheeler and also the cash of Rs.9,800/-, and immediately the petitioner contacted the police through Emergency No.100 and they rushed to the spot of incident and advised the petitioner to lodge a complaint with the concerned police. Immediately, on the same day the petitioner lodged a complaint before the respondent police. https://hcservices.ecourts.gov.in/hcservices/
After receiving the complaint, the respondent assigned CSR in No.425/R3X/2015 dated 11.09.2015.
But, thereafter the respondent has not taken any action on the said complaint. Hence, the present criminal original petition is filed for the aforesaid prayer.
3.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4.Considering the submissions made on either side, this Court is of the opinion that it is appropriate to direct the respondent to enquire the matter and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the respondent is directed to proceed further in accordance with law, within a period of four months from the date of receipt of a copy of this order.
5.With the above directions, this criminal original petition is disposed of.
