Writ petition is filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, directing the respondent to commence and conclude the proceedings pending on the file of the respondent in Second Appeal filed by the petitioner on 06.05.2024 under Section 19 of Right to Information Act, 2005 within two months and the respondent to furnish appropriate information as requested by the petitioner and pass orders. ORDER
Mr.C. Vigneshwaran, Standing Counsel takes notice for the respondent.
2. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. This writ petition is filed for a Writ of Mandamus directing the respondent to commence and dispose the petitioner's complaint dated 06.05.2024 filed under Section 19 of Right to Information Act, 2005 pending on the file of the respondent within two months and to furnish the information sought for.
4. The petitioner filed an application seeking certain information under Section 6(1) of the RTI Act on 19.12.2023, to the Public Information officer of TNMSC. In pursuance of the application submitted by the petitioner, the Public 2/6
Information Officer furnished certain information. However, the petitioner was not satisfied. Therefore, the petitioner preferred an appeal on 31.01.2025, to the First Appellate Authority. Even the First Appellate Authority did not provide the accurate details sought for by the petitioner. Therefore, the petitioner preferred second appeal before the State Chief Information Commissioner on 06.05.2024. As no action was taken on the petitioner's second appeal the petitioner was constrained to the file the above writ petition for the above said relief.
5. The learned counsel for the petitioner submits that the appeal is kept pending for more than one year and therefore, appropriate orders may be issued to the respondent to pass final orders in the appeal, within the time frame fixed by this Court.
6. The learned standing counsel for the respondent submits that in the petitioner's second appeal dated 06.05.2024, notice of enquiry was sent to the petitioner, calling upon him to appear for an enquiry on 18.06.2024, at 11. a.m 3/6
7. Heard both sides and perused the materials available on record.
8. In view of the above facts, a direction is issued to the respondent to conduct the enquiry and pass final orders in the second appeal, within a period of twelve weeks from the date of receipt of a copy of this order.
9. Accordingly, this writ petition is disposed of. However, there shall be no order as to costs.
