O R D E R

This petition has been filed seeking a direction to the respondent to register the complaint of the petitioner dated 19.08.2015 and investigate the same and also file the final report.

2. According to the petitioner, the petitioner is an agriculturist. He is having 1 acre and 20 cents of land in the Tank Bund comprised in S.No.11/7A at Veppankuppam Village. One Yogalakshmi who is the owner of the adjacent land of the petitioner wantonly and deliberately trespassed into the land of the petitioner and cut down the entire Mango and Guava trees belonging to the petitioner. Therefore, the petitioner has given a complaint to the respondent police and on receipt of the same, C.S.R.No.206 of 2015 has been assigned by the respondent police. Thereafter, no action has been taken by the respondent police till date. Hence, the petitioner has filed the present criminal original petition.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and also perused the materials available on record. https://hcservices.ecourts.gov.in/hcservices/

Considering the submissions made on either side, this Court is of the opinion that the respondent is directed to conduct enquiry, based on the complaint of the petitioner dated 19.08.2015 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the respondent is directed to proceed further in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order.

5. With the above directions, this criminal original petitions is disposed of.
