The Senior Regional Manager v. R. Balaji

C.M.P.No.19903 of 2016 in W.A.No.1612 of 2016 N.R.R.J., & S.M.S.J., This Petition has been filed for staying the operation of the order dated 22.09.2016, made in W.P.No.27837 of 2015.

2.We are informed that the Corporation has already acted on the Judgment rendered by the learned single Judge and reinstated the respondent into service and is currently discharging his duties.

3.In that view of the matter, liberty granted by the learned single Judge to proceed against the writ petitioner independently as a measure of discipline and control, is somewhat appropriate to be allowed to be pursued by the appellant/ Corporation, rather than staying the operation of the order passed by the learned single Judge, as that might result in checking out the writ petitioner once again discharging him from service.

4.In that view of the matter, we do not consider that a reasonable case is made out for suspension of the operation of the Judgment of the learned single Judge.

The above Petition is dismissed accordingly.
