ORDER

(Order of the Court was made by SATISH K. AGNIHOTRI, J.) Seeking a direction to the second respondent to dispose of the appeal dated 13th ultimo, the instant writ petition is filed.

2. Today, we are informed by the learned counsel for the petitioner, by producing a copy of the order dated 10th instant, that during the pendency of this writ petition, the second respondent has dismissed the appeal dated 13th ultimo filed by the petitioner and thus, nothing survives for further adjudication in this writ petition.

3. In view of the above submission made by the learned counsel for the petitioner, this writ petition is dismissed as having become infructuous. It is open to the petitioner to challenge the said order dated 10th instant, if so advised, under the provisions of law. No costs.
