This Criminal Original Petition has been filed seeking to quash the FIR in Crime No.113 of 2022 pending investigation on the file of the 1st respondent.

2. The main ground taken by the learned counsel for the petitioner is that the plea of alibi.

3. A perusal of the FIR shows that there are serious allegations. Further, the plea of alibi cannot be gone into at this stage as it requires evidence and it has to be seen only during investigation. It is for the Investigating Officer to conduct the investigation in a fair manner and take it to the logical end.

4. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed.
