ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to the judicial custody on 22.06.2021 for the alleged offence under Sections 341, 392 and 397 of IPC in Cr.No.459 of 2021 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant and robbed a cell phone and also cash of Rs.3,000/- Based on the complaint lodged by the defacto complainant, the respondent police registered a case against the petitioner and other accused.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant bail to the petitioner.
4.The learned Government Advocate submitted that the property has been recovered by the respondent police and there are three previous cases pending against the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5. Taking into consideration the facts and circumstances of the case and also of the fact that there are three previous cases pending against the petitioners and he is habitual offender and historysheeter, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 16/07/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
