Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the respondents dispose of the representation dated 09.08.2016 requesting the respondents 1 to 6 to immediately remove the pathway in the patta land measuring an extent of 5.08.5 hectres in S.F.Nos.789/1 (1.54.0 hectares) 791/2 (0.90.5 hectares) 791/1 (1.16.0 hectares) 789/2 (0.60.hectares) and 788/2 (0.88.0 hectares) in Chinnakalrayan Therkunadu Village, Attur Taluk, Salem District in accordance with law to enable the petitioner to submit the approved mining plan for the said area as per the directions

of the Additional Chief Secretary to Government Industries (MMB-2) Department Secretariat Chennai-600 009 in his letter No.19197/ MMB.2/2013 dated 19.07.2016.

The learned counsel for the petitioners would submit that he is not pressing the writ petition in respect of the 2nd petitioner and that he has also made an endorsement in the writ petition to that effect. In view of the submission and endorsement made by the learned counsel for the petitioners, the writ petition in respect of the 2nd petitioner herein, viz., T.Ranjithkumar, is dismissed as withdrawn. No cost.

The writ petition in respect of the 1st petitioner is admitted. Issue rule nisi. Call for the records in eight weeks. 05.10.2016 AP NOTE:-The Registry is directed to post the writ petition in respect of the 1st petitioner after eight weeks.
