The suit had been filed seeking recovery of a sum of Rs.1,71,38,984/- together with interest on the principal amount of Rs.25,00,000/- from the date of filing the plaint till the date of realisation and also for costs and further interest.

It is the case of the plaintiff that the defendants had issued 17 separate cheques drawn on M/s.ING Vysya Bank Limited, Anna Nagar Branch within the jurisdiction of this Court and the plaintiff had deposited the cheques in his Bank account, Indian Bank, Sowcarpet Branch, Chennai 600 079, again within the jurisdiction of this Court. The cheques had been dishonoured for the reason "Account closed". Thereafter, notice has been issued and now the suit had been filed seeking recovery of the amount. It is also stated that the 1st defendant had also executed a Promissory Note for amounts obtained on the said date. Though the substantial cause of action has arisen within the jurisdiction of this Court, but since the defendants are living outside the jurisdiction of this Court, leave is sought.

Since the cause of action had arisen within the jurisdiction of this Court so far as the relief to claim money is concerned, leave is granted. Registry is directed to number the plaint if it is otherwise in order.
