CR.NO.44/2022.

For Petitioner : M/S N.VIJAYA BASKER Advocate For Respondent : M/S. A.DAMODARAN, ADDITIONAL PUBLIC PROSECUTOR PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 286 of I.P.C and Section 5 of Explosive Substance Act, 1908 in Crime No.44 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused were found in possession of 88 pockets of explosive materials viz., Special Ordinary Detonators 9300 grams illegally. Hence, the complaint.

3. It is seen from the records that this is the second anticipatory bail petition filed by the petitioner. The earlier petition filed by the petitioner in Crl.O.P.No.12071 of 2022 was dismissed on 20.05.2022. He would further submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent condition that may be imposed on him.

4. The learned Additional Public Prosecutor would submit that there is no change of circumstances after the previous order was passed on merits. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
