JUDGMENT
When the matter came up for hearing yesterday (20.03.2019), the learned counsel appearing for the appellant submitted that he has no instructions from the appellant and the learned counsel appearing for the respondent submitted that the matter has already settled between the parties.
In the above circumstances, the matter was listed by printing the name of the appellant. But, today, when the matter was called, the appellant called absent. Hence, the Second Appeal stands dismissed for non-prosecution. No costs. Consequently, the connected Civil Miscellaneous Petition is closed.
