ORDER

The petitioner apprehends arrest for the alleged offence under Sections 115(2), 126(2), 296(b), 308(2), 351(3) of BNS and Section 4 of TN Prohibition of Harassment of Women Act, in Crime No.183 of 2026 on the file of the respondent police seeks anticipatory bail.

The allegation against the petitioner is that, under the influence of alcohol, the petitioner along with other accused waylaid the defacto complainant and demanded money and when he refused, the petitioner is alleged to have assaulted the defacto complainant as well his son. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and has not committed any offence as alleged by the prosecution. He further submitted that the first petitioner has already been enlarged on bail by the learned Sessions Judge. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) for the respondent police, reiterated the prosecution case and submitted that the petitioner has no previous case in his credit. Hence, he opposed the grant of anticipatory bail.

5. Considering the totality of the circumstances of the case, it is seen that the occurrence took place on 02.04.2026 and FIR was registered on 03.04.2026. The allegation against the petitioner is that he assaulted the defacto complainant

and his son indiscriminately. Though the co-accused had already been released on bail, this Court is of the firm view that the nature of the offence alleged against the petitioner has a serious societal impact. Hence enlarging the petitioner on anticipatory bail at this stage would affect the moral fiber of society at large. In such view of the position, this Court is not inclined to enlarge the petitioner on anticipatory bail.
