O R D E R
The present criminal original petition has been filed to direct the second respondent police to hand over the petitioner's complaint dated 13.07.2015 to his personnel and to conduct investigation.
2. In the petition, it has been stated that the petitioner is the wife of one Srinivasan, who is a software Engineer. Due to some misunderstanding, the petitioner and her husband had separated from each other from 2012 to April, 2015. During the above period, the husband of the petitioner had developed an illicit intimacy with one Subasri, who was also separated from her husband. They were living together for a period of 3 to 4
months. During that period they were staying in the matrimonial home of the petitioner at KKR Garden, Madavaram, Chennai and within a period of 3 to 4 months, there was some misunderstanding between the husband of the petitioner and his paramour Subasri. In pursuant to the misunderstanding, she had left the company of the husband of the petitioner and while she was living, she took away the original title deeds of the house, purchased by her husband and took away nearly Rs.15 Lakh worth of electronic gadgets including mobiles, tablets, smart phones, professional cameras, laptops etc., Thereafter, the petitioner and her husband reunited and are living together in the above address. Only then the petitioner and her husband had come to know about the missing of the title deeds as well as the gadgets, hence they preferred a complaint. Since no action has been taken on the complaint lodged by the petitioner, he has come forward with the present petition.
3.Today, when the matter is taken up for consideration, learned Additional Public Prosecutor submitted that on completion of investigation, the complaint was closed. He has also produced the closure report for the perusal of this Court.
4. In view of the same, since the complaint was already enquired and closed, nothing survives in this petition. Hence, the present criminal original petition is dismissed. However, the petitioner is at liberty to workout her remedy in the manner known to law.
