O R D E R
This Writ Petition has been filed praying for a writ of Mandamus directing the respondents to conduct the preliminary enquiry on the complaint given by the petitioner dated 4.7.2021.
2. The case of the petitioner is that the he was running the Tourist Cabs in the name of Santhosiya Travels in Orathanadu, Thanjavur District. Earlier 10 years back, he was impleaded in a murder case, which was ended in acquittal. After acquittal of the three cases in the year 2006, there is no case pending against him.
3. The petitioner further submitted that on 18.6.2021, the Inspector of Police, Muthupettai Police Station, had taken the petitioner to the police station and enquired about his vehicle bearing registration No.TN-49-BH-9113 (Tourist van). Police Station had demanded bribe to release the vehicle. Therefore, the petitioner had given a complaint to the 2nd respondent. As the 2nd respondent has not taken any action on the complaint of the petitioner under the prevention of corruption Act, the present writ petition has been filed to conduct the preliminary enquiry on the complaint given by the petitioner dated 4.7.2021.
4. When the matter is taken up for hearing today, the learned Government Advocate for the respondents submitted that the complaint of the petitioner dated 4.7.2021 has already been forwarded to the second respondent for taking steps and proceed further accordingly.
5. In view of the said submissions made by the learned Government Advocate for the respondents, the second respondent is directed to take further action on the complaint of the petitioner, dated 4.7.2021, within a period of two months from the date of receipt of a copy of this order, if prima-facie case is made out, proceed further against the respective person in accordance with law.
6. Accordingly, the writ petition is disposed of. No costs.
