This Company Application was allowed on 23.02.2024. However, there was a mistake in the same/order and therefore this case is listed today under the caption "for clarification".

2. The learned Deputy Official Liquidator submits that all the records were handed over to M/s.IL & FS Financial Services Limited, who are the assignee of the debts that the Company under liquidation namely M/s.Best & Crompton Engineering Limited.

3. It is at that stage the learned Deputy Official Liquidator's office also came to know that the said company namely M/s.IL & FS Financial Services Limited claims to have lost the documents due to theft after all the records were handed over to them in the year 2019. The learned Deputy Official Liquidator submits that no records are available with the office of the Official Liquidator.

4. It is also informed by the learned Deputy Official Liquidator is that application has been filed in A.No.76 of 2023 to initiate against M/s.IL & FS Financial Services Limited.

5. Under these circumstances, order passed on 23.02.2024 is recalled after recording the submission of the learned Deputy Official Liquidator. However, liberty is given to the applicant to move suitable application against the said assignee namely M/s.IL & FS Financial Services Limited. 14.11.2024 jas C.SARAVANAN,J.
