PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent police to conduct further investigation in Crime No.450 of 2016 and consequently to file charge sheet therein. O R D E R

This petition has been filed by the petitioner/mother of the deceased, to direct the first respondent police to file final report at early in Crime No.450 of 2016.

2. The learned counsel for the petitioner has submitted that, the petitioner's son namely Karthikeyan died on 08.10.2016 in road accident and with regard to the same, the second respondent herein has lodged a complaint before the first respondent on 10.10.2016 and based on the same, the first respondent has registered a case in Crime No.450 of 2016 under Section 279 and 304(A) IPC. He further submitted that even though the case was registered in the year 2016, for the past two years, the first respondent has not traced out the vehicle, which is involved in the said crime and because of the same, the petitioner is not even able to file claim application for getting compensation before the Motor Accident Claims Tribunal. Therefore, he requests to direct the first respondent to https://hcservices.ecourts.gov.in/hcservices/

expedite the investigation to trace out the vehicle and file final report early.

3. The learned Additional Public Prosecutor has submitted that the investigation is in progress and seeks four weeks time for filing final report.

4.Considering the aforesaid submissions, the first respondent is directed to expedite the investigation and file a final report within four weeks from the date of receipt of a copy of this order.

5. With the aforesaid observations, this Criminal Original Petition is disposed of.
