JUDGMENT
(The Order of the Court was made by N.Sathish Kumar) Challenge has been made to the order of the learned Single Judge closing the Contempt Petition.
2. Originally, a Contempt Petition has been filed by the original petitioner in the writ petition for disobeying the order dated 16.10.2020 passed in W.P.No.29276 of 2019. During the pendency of the contempt petition, it is stated by the respondent that writ appeal has been filed against the order of the writ Court and the writ petitioner died and the
legal heirs were not brought on record.
3. Learned counsel for the appellants would submit that the appeal filed by the respondent was already dismissed by this Court by order dated 14.07.2025. The legal heirs have also been brought on record and the cause titled was also accepted.
4. The issue is only with regard to the applicability of GPF Scheme or CPF Scheme. The writ petitioner joined in the service of the respondent University on 01.11.1988. At that time, he was absorbed in G.P.F. scheme. Therefore, the contention of the respondent that CPF Scheme only would apply to him, cannot be countenanced. Hence, the submission of the legalheirs that they are entitled to canvass that point in the contempt petition, cannot be denied. The writ Court has directed the first respondent therein to take a comprehensive decision and pass appropriate orders towards settlement of GPF benefits to the petitioner therein within a specified period. In such view of the matter, closing the contempt petition is not proper, as the order has not been complied with. The legal heirs are entitled to continue with the contempt proceedings.
Therefore, the order passed by the learned single Judge dated 19.10.2022, closing Contempt Petition, is set aside. The matter is remitted back to the learned Single Judge for fresh consideration. The Contempt Petition stands restored and it is to be heard on merits. Accordingly, the Appeal is ordered. No costs. (N.S.K.,J.) (M.J.R.,J.) vsi 06.11.2025
