Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 & 2 to conduct survey on petitioner's land in S.F.No.347 measuring an extent of 4.22 acres in Injampalli Village Modakurichi Taluk, Erode District by deputing Surveyor by considering the petitioner representation dated 22.08.2023 and 27.11.2023 for conducting survey.

The petitioner herein seeks a direction to the respondents 1 & 2 to conduct Survey on the petitioner's land in S.No.347 measuring an extent of 4.22 acres in Injampalli Village, Modakurichi Taluk, Erode District, by considering her representations dated 22.08.2023 and 27.11.2023.

2. According to the petitioner, she has been in possession and enjoyment of the above mentioned land with the patta in her name. It is also stated that she succeeded to the property, which originally belonged to her husband and after his death, the petitioner succeeded to the property. She submitted a representation seeking survey of the land, the same was objected by the third respondent without any right. Hence, the petitioner is before this Court.

3. Mr.P.Sathish, learned Additional Government Pleader takes notice for the respondents 1 & 2.

In view of the admitted position regarding the third respondent's objection to survey of the land, without going into the merits of the claim of the parties, this Court is inclined to issue a direction to the first respondent to consider the representations of the petitioner dated 22.08.2023 and 27.11.2023 seeking survey of her land, after issuing notice to the third respondent and pass final orders, within a period of 8 weeks from the date of receipt of copy of this order.

5. With the above directions, this Writ Petition is disposed of. No costs.
