O R D E R

This Criminal Original Petition is filed seeking a direction to the respondent to register a case in C.S.R.No.356 of 2015 dated 08.10.2015 and investigate the same and to file a final report within the stipulated time.

2. In the affidavit filed by the petitioner, it is stated that the petitioner lodged a complaint with the respondent police on 08.10.2015 against one Shanthi, her younger brother, viz. Jayaguru and ten others on the allegation that they came with wooden logs, iron rods and knives into the petitioner's house, threatened him and tried to barge into his house by breaking open the doors of his house. It is the case of the petitioner that though the respondent police issued CSR vide CSR No.356/2015 on 08.10.2015, they refused to register the case. Since no action is taken on the complaint of the petitioner, the petitioner has filed the present petition seeking the above relief.

3. Heard both sides.

4. When the matter is taken up for consideration today, learned Additional Public Prosecutor, producing a copy of the FIR, submitted that the police has registered an FIR in Crime No.876 of 2015 for the alleged offences under Sections 147, 294(b) and 506(i) IPC on 01.11.2015.

5. In view of the above submissions and taking note of the fact that FIR has been registered in Crime No.876 of 2015, nothing further survives for consideration in this matter.

Accordingly, this Criminal Original petition is dismissed as having become infructuous.
