This petition is filed seeking to modify the condition "this Court is inclined to grant bail to the petitioner on deposit of Rs.15,000/- towards compensation" imposed by the Principal Sessions Judge, Kancheepuram District at Chengalpattu in Crl.M.P.No.3108 of 2015 vide order dated 29.10.2015. 2.
Heard both sides.
3.
The Court below, on 29.10.2015, while granting bail to the petitioner in Crl.M.P.No.3108 of 2015, apart from the regular bail conditions, directed the petitioner to deposit a sum of Rs.15,000/- before the learned Judicial Magistrate, Tambaram in Cr.No.2952 of 2015 of Sankar Nagar Police Station. 4.
Learned counsel for the petitioner would mainly submit that in the absence of any undertaking by the petitioner to https://hcservices.ecourts.gov.in/hcservices/
deposit the amount, the condition imposed by the Court below directing him to deposit the amount of Rs.15,000/- would put the petitioner to irreparable loss. Hence, he seeks modification of the said condition imposed by the Court below. 5.
I find force in the submissions of the learned counsel for the petitioner. Hence, the bail condition imposed by the Court below in Crl.M.P.No.3108 of 2015, vide order dated 29.10.2015 that "the petitioner shall deposit a sum of Rs.15,000/- before the Judicial Magistrate, Tambaram in Cr.No.2952 of 2015 of Sankar Nagar Police Station", is hereby deleted.
Except the above modification, the remaining portion of the said order shall stand unaltered.
