Mrs.Pasoorammal (Deceased) v. Thulasilingam
CMP Nos.18500, 18502 and 18503 of 2021 in S.A.No.977 of 2009 J.NISHA BANU, J.
These are the applications to condone the delay of 918 days in filing the petition to set aside the order of abatement, to bring on record the legal heirs of the deceased sole appellant and to set aside the order of abatement.
2.The learned counsel for the appellants would submit that since the 4th appellant/6th respondent is not in talking terms with the 2nd appellant, the learned counsel for the appellants has filed an application to implead her as 4th appellant.
3.The learned counsel for the respondents, who is appearing on behalf of the respondents 1 to 5 do not have any objection for allowing these applications. The learned counsel for the respondents would submit that the 4th appellant is the legal heir of the first appellant.
4.Being satisfied with the reasons stated in the affidavit and no objection stated by the learned counsel for the respondents, these applications are allowed.
5.Registry is directed to carry out the necessary amendment and list the matter on 04.01.2022.
