Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to pass orders on merits on the petitioner's representation dated 08.08.2017 demanding release of his accumulated earned leave standing to his credit on the date of his retirement, without any further delay. The case of the petitioner is that, petitioner is facing recovery proceedings for a huge sum above Rs.5,00,000/- after his retirement without proper enquiry and that accumulated earned leave arrears has been stopped. The petitioner submitted a representation on 08.08.2017 to the respondent. Since, there was no response to the petitioner's representation, the petitioner has approached this Court.
3.The learned counsel for the petitioner states that the respondent can be directed to dispose of the petitioner's representation dated 08.08.2017 demanding release of accumulated earned leave to his credit on the date of his retirement and pass appropriate orders, within a time stipulated by this Court. https://hcservices.ecourts.gov.in/hcservices/
4.Considering the limited scope of the prayer that is sought in this writ petition, without expressing any opinion on the merits of the petitioner's representation, this Court directs the respondent to consider the representation of the petitioner dated 08.08.2017 and to pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
5.With the above direction, this writ petition is disposed of. No costs.
