It is reported that the sole respondent in the Second Appeal died on 19.05.2013.
2.The appellants filed the above petitions to condone the delay of 2522 days; to set aside the abatement caused and to substitute the legal heirs/proposed respondents 2 to 5 on record.
3. The learned counsel for the appellants entered appearance for the proposed respondents 2 to 5 has no serious objection to allow this petition. 4.Perused the affidavit in support of the condone delay petition and satisfied with the reasons stated therein. Accordingly, these CMPs are ordered as prayed for and delay is condoned.
5.Registry is directed to carry out the necessary amendment. 6.Issue notice to the impleaded respondents 2 to 5 in the second appeal returnable by three weeks. Private notice is also permitted.
7. Post the matter after three weeks.
