Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue 1/6

a Writ of Mandamus, directing the Respondents 1 to 3 to consider the petitioner's presentations dated 28.12.2020 thereby directing the 4th Respondent to release the pending salary to the tune of Rs.2,62,548/- and to issue experience certificate. ORDER

The petitioner, who has filed this Writ Petition, seeks direction from the 4th respondent to release the pending salary and issue an experience certificate.

2. As per the claim of the petitioner that his salary pertaining to the period between 01.04.2020 to 30.09.2020, has not been paid by the 4th respondent and his representation given to that effect was also not considered so far.

3. Heard, Mr.T.Muthu Krishnan, learned counsel for the petitioner, Mr.B.Rabu Manohar, learned Senior Central Government Counsel for the first respondent and Mr.T.Cheziyen, learned Additional Government Pleader for the second and third respondents and perused the materials available on record.

4. The learned counsel for the petitioner submitted that the petitioner, who was initially appointed as an Assistant Professor on 07.06.2019, has currently 2/6

resigned his job. At the time of his appointment, his salary was fixed as Rs.45,000/- per month and for the period he worked between 01.04.2020 to 30.09.2020, and the said salary was not paid to him. The petitioner had given representation to the 1st respondent to return his original certificates and after a considerable delay, the certificates were handed over to him. However, the only concern of the petitioner is that his salary for the five month period for which he worked has not been settled yet.

5. The 4th respondent has not made any objection by making his appearance despite notice being served on him.

6. Since the representation of the petitioner has not been considered, respondents 1 to 3 shall look into the matter and issue appropriate direction to the 4th respondent with regard to the disbursal of the pending salary to the petitioner.

7. It is up to the petitioner to give a fresh representation to the respondents 1 to 3 in this regard and on receipt of the same, the respondents 1 to 3 shall consider and pass appropriate orders in accordance with the law within a period of three weeks from thereon.

With the above direction, this Writ Petition stands disposed. No costs. 3/6
